What is Racketeering?

Brought under 18 USC §1962, a Federal Racketeering (RICO) charge essentially accuses individuals of being involved in an illegal enterprise which exists, in part, to violate certain federal and state laws.  The elements of RICO are generally as follows:

  1. An enterprise existed

  2. The Defendant was associated with the enterprise

  3. The Defendant participated or conducted, directly or indirectly, in the conduct of the affairs of the enterprise through a pattern of racketeering activity

  4. The defendant engaged in a pattern of racketeering activity, which is to commit at least two acts of racketeering

  5. The enterprise’s activities affected interstate commerce
