Most people living in Southeast Michigan, and Detroit in particular, know about the existence of street gangs. In the past five years, the Government, primarily by the Bureau of Alcohol, Tobacco, and Firearms (the ATF), have extensively prosecuted street gangs throughout the City of Detroit. Given that we have represented defendants from basically every one of these prosecutions, we are very familiar with these types of cases and the Government tactics before and during trial.

How the Government Prosecutes a Street Gang

Prosecuting a street gang under RICO is fairly straightforward. The Government will allege that a street gang exists, like the Bounty Hunter Bloods for example. Then, they will accuse somebody of being a part of the gang. Next, the Government will draft an extensive indictment, which will describe the activities of the alleged gang though individual allegations called “overt acts.” Finally, the Government will add additional allegations to the Indictment, which can dramatically increase the person’s criminal exposure.
