Federal Criminal Defense Strategy Starts the Moment we Get the Call

A federal criminal case is as serious as a criminal case can get. Having a strategy is something that is imperative from the moment the representation begins. Every client going through a federal criminal case in Michigan has an individual situation that requires a specific strategy. A good federal criminal lawyer knows that not having a strategy is akin to giving up.

What to Do First?

A federal case starts with a federal investigation and many times we are contacted by clients during this time. Although charges have not yet happened, we first ascertain who is handling the case for the United States Attorneys Office and then contact them to see what information we can gather about where the case may go. Second, we begin our investigation. The key to a successful federal representation at this stage is using every tool at our disposal to ascertain what is happening, and get ahead of potential charges.

If Federal Charges Happen

If you are charged via a federal complaint or indictment, then the next step is to go to court and attempt to obtain you pretrial release. Federal cases take a very long time and we strive to keep you out of custody so you don’t have to wait for years in jail for your case to go to trial. Also at this point, we are doing everything we can to obtain discovery through the US Attorney, while at the same time conducting our investigation.

Once We Get Discovery

Once we obtain discovery, we have our experts analyze it, and our lawyers pour through it to find issues. We then file extensive motions to do all sorts of things, including getting evidence suppressed, force the government to produce proffered statements, and many other things. Motion practice offers a chance for us to employ certain strategies that will either give us leverage for a more favorable plea agreement or to set us up for trial.

In order to give your client the best chance of winning their case, you have to have a trial strategy in place well ahead of time. This includes filing motions in limine that later effect what evidence the government is barred from introducing at trial. Everything we file has a purpose, everything we do has a reason.
