The most complex of all conspiracies is a racketeering or RICO conspiracy. Federal RICO laws essentially prohibit illegal “enterprises.” An individual convicted of federal racketeering can be sentenced for the underlying crimes in which they committed for the enterprise. For example, if a cartel member killed a rival drug dealer to better the cartel, the that person could be charged with murder, even the death penalty!

What makes RICO all the more complex is that the Government’s tool of choice is to charge RICO conspiracies. In a RICO conspiracy, the Government need only prove that a member or associate of the enterprise had knowledge that other members of the enterprise were committing the types of crimes (murder, drug dealing, etc.) which are prohibited under RICO. Thus you don’t even have to commit a crime to be found guilty of RICO conspiracy.
