Federal Drug Conspiracies

Federal drug conspiracies are one of the major types of cases frequently prosecuted by the United States Attorney for the Eastern District of Michigan. In almost every federal drug case we handle, there is a charge for a drug conspiracy. A drug conspiracy is basically is a criminal partnership where two or more people conspire together to violate federal drug laws. Stemming both from 21 USC §846 and 18 USC §371, the elements of conspiracy are: that two or more people conspired or agreed to violate federal drug laws; that the accused knowingly and voluntarily joined the conspiracy; and that a member of the conspiracy did an overt act to further the conspiracy.

Agreeing to a conspiracy does not take much. There is no requirement of a formal agreement, nor does the alleged conspirator have to know all of the activities of the conspiracy. Mere knowledge of the conspiracy is not enough, but make no mistake, the Government has no problem charging minor players, like wives and mothers for instance, with conspiracy.
