Drunk Driving Felony Livingston County NOT GUILTY!!!

Winning a drunk driving felony trial anywhere in Michigan is difficult, but to win the trial in Livingston County, that is a miracle! Well that is exactly what happened when Jim Amberg went to trial against the Livingston County Prosecutor’s Office in a hotly contested drunk driving felony. Jim’s client was driving his motorcycle when the bike suddenly lost control. Flung from the motorcycle, Jim’s client landed in the middle of the road and was severely injured.

Rather than make any attempt to give aid to Jim’s client, the Livingston County Deputies instead searched the motorcycle and discovered a couple of pounds of marijuana. Then, as the client was being put in the ambulance, the deputies asked repeated questions about the client’s drug and alcohol use prior to driving the bike.

Once at the hospital, the deputies continued, drawing blood from Jim’s client. The result of this draw was a positive blood test result for both marijuana and alcohol. Regardless of that result, Jim’s client would lose his job, his career, and his life if he took a plea.

Prior to trial, Jim convinced the prosecutors that because Michigan had recently decriminalized marijuana, his client could not be charged with the marijuana found on the bike. Then Jim filed extensive motions, even going up to the Court of Appeals and back. Finally the trial took place. Jim destroyed the state police lab experts. One of them was cross-examined so hard that he curled into a ball while on the stand! After a week-long trial, the jury went out and found Jim’s client NOT GUILTY of all charges!!!
