Kilogram of Heroin Case Dismissed by Oakland County Circuit Court

In one of the crazier felony drug cases Jim Amberg has handled, he recently was able to get a case dismissed where his client was discovered with a kilogram of heroin in Rochester. Jim’s client was arrested by the notorious Oakland County Narcotics Enforcement Team, otherwise known as the NET team. The Net team used their typical tactics of using anonymous informants and not keeping any records of their actions in obtaining a search warrant of Jim’s client’s condo. Once a search warrant was executed, a large amount of heroin and money were discovered. Jim’s client was looking at a potential 30 year sentence.

Jim became suspicious as to how the NET team had repeatedly known where his client was at. Having handled many federal cases where tracking devices are used, Jim suspected that a tracking device was planted on his client’s car. However, doing this requires obtaining a search warrant, and Jim was never provided with such a warrant. Prior to trial, Jim filed a multitude of motions, arguing that something was amidst, pointing to various prior cases where the NET Team detective had lied under oath. At this point, these motions were denied.

Once the jury trial started, the Oakland County Prosecutor called the NET team detective to the stand. On cross examination, Jim sprung the trap. He asked him whether or not there was a tracking device on the vehicle, to which the NET team detective said yes! Then Jim asked him if he had obtained a warrant, and he said yes!! Then Jim looked at the prosecutor and said where’s the warrant!!!

There was an immediate mistrial and the Court decided to revisit the motions that Jim had filed concerning the truthfulness of the NET team detective. The Court then conducted an evidentiary hearing which included testimony from the detective, a pontiac judge, and the head of the drug unit for the Oakland County Prosecutor’s Office. At the conclusion of the hearing, the Court found that the NET team detective was not credible, and it then suppressed all of the evidence discovered in the condo.

Jim and his client were ecstatic!!!! But the only way this result happened was because of the relentless investigation and fearless litigation that is required to make a miracle happen, just like it did here!
